PROTECTOR
A protector is a person (individual or corporate), who is not usually a trustee, that is appointed by the settlor during his lifetime, under the terms of his Will or his immediate family on his demise, or in the absence of any decision being made in such circumstances, by the trustee(s).

A protector, as the holder of an office under the trust deed, is authorised or required to take part in the administration of the trust. The extent of a protector’s involvement varies greatly, for they are appointed for a number of reasons.

A protector may for instance, have the ability to appoint or remove trustees, make or approve amendments to the administrative powers of the trust or to veto the exercise of any reserved powers of the settlor. The powers of a protector are generally discretionary based.

A protector is usually appointed in order that the beneficiaries of a trust may approach someone familiar with the trust, but independent of the trustees, who they can consult in relation to the trust’s affairs.
